Can You Hold Two Jobs on an H-1B at the Same Time?
Can you work for two employers at the same time on H-1B?
Yes. H-1B workers can work for multiple employers, but the second employer must file a concurrent H-1B petition on your behalf. The process is generally similar to a regular H-1B petition: the employer must obtain a certified Labor Condition Application (LCA), prepare an employer support letter, and file Form I-129, selecting “concurrent employment” on the form.
Under the H-1B portability rules, eligible workers may begin working for the second employer once USCIS receives a properly filed concurrent H-1B petition, without waiting for approval. If the concurrent petition is denied, that does not automatically invalidate your original H-1B approval. As long as your original H-1B remains valid and you continue to meet the applicable status and employment requirements, you may continue working for your original employer, but you must stop working for the second employer.
There is no specific numerical limit on concurrent H-1B employers, but your work arrangements must be realistic, and you must have enough time to fulfill the responsibilities of each position. In our experience, working for two or three employers is more common, with some positions being part-time. Concurrent H-1B employment can also include remote work, provided it complies with the applicable H-1B and LCA requirements, including those concerning work locations.
