哈喽大家好,H-1B签证快满6年了,但是PERM和I-140递交得太迟了,没有办法达到延期的条件,该怎么办?如何衔接身份?这是非常多客户问到的一个问题,我们今天来做解答。
第一个我们需要知道,H-1B六年延期的例外有哪些。一般有两种情况:第一,PERM递交已经超过一年;第二,I-140已经获得批准,并且排期还没到。在这两种情况下,我们可以申请一年或三年的延期。
但如果六年快到了,又无法延期,那该怎么办呢?我们通常有几个选择。
第一个方法是考虑转换身份,继续合法留在美国,比如B-2旅游签证、F-1学生签证,或者配偶签证,比如H-4、L-2、O-3等。不过要注意的是,如果你转换的是不能工作的签证(例如B签证或某些配偶签证),你将没有工资收入,而这可能会影响你在I-140阶段对资金能力的证明,从而影响整个绿卡流程。所以你转换成哪种身份,最好提前和律师沟通清楚。
第二个方法是出境等待。我们有客户在H-1B的第五年六个月时选择出境,这样六年的时间就暂停计算了。他在境外等待,直到满足延期条件后,我们再帮他递交延期申请,通过面签重新入境。需要注意的是,这种方式适用于雇主仍愿意为你申请绿卡的前提下,而且离开后工资是否中断也会影响雇主在I-140阶段提供工资支付能力的证明。
第三种方式是“recapture”,适用于那些在六年内有频繁出入境记录的申请人。如果你累计在境外的时间达到六个月或以上,那么在六年期限将至时,可以申请H-1B recapture,把之前未用的时间补回来,从而延长在美的停留时间。

Hello everyone, the H-1B visa is about to reach its 6-year maximum, but the PERM and I-140 were filed too late, so you're no longer eligible for an extension. What can you do to maintain your legal status? This is a common question we receive from many clients, and we’re going to break it down today.
First, let’s understand the exceptions to the 6-year H-1B limit. There are generally two: (1) your PERM has been pending for over one year, or (2) your I-140 has been approved and your priority date is not yet current. In either of these situations, you may qualify for a one-year or three-year H-1B extension.
However, if you’re approaching the end of your 6 years and are not eligible for an extension, what are your options?
One option is to change your status to remain legally in the U.S., such as switching to a B-2 tourist visa, an F-1 student visa, or a dependent visa like H-4, L-2, or O-3. But keep in mind: if the new status does not allow you to work (like B visas or certain dependent statuses), you will no longer have income. This could affect your ability to meet the financial requirements during the I-140 stage of the green card process. Therefore, you should always consult with an attorney before changing status.
The second option is to leave the U.S. and wait abroad. For example, we had a client who left the U.S. at 5 years and 6 months. That pause stopped the H-1B clock. He stayed outside the U.S. until he became eligible for an extension, we filed the petition, and he re-entered through consular processing. Keep in mind, though, this approach only works if your employer is still willing to sponsor your green card after you leave, and whether your pay was interrupted during your absence may also impact your employer’s ability to demonstrate financial capability at the I-140 stage.
The third option is to recapture unused time. This is for applicants who frequently traveled outside the U.S. during their H-1B period. If the total time spent abroad adds up to six months or more, you can file a recapture request to reclaim that unused time and extend your stay accordingly.
