Marriage-Based Green Card: What You Should Know

How soon can you apply for a marriage-based green card? After getting married, if you have sufficient evidence, you may immediately file a marriage-based green card application without any issue.
What is a two-year conditional green card? If, by the time USCIS reviews your marriage-based green card case, your marriage has lasted less than two years, USCIS will issue a two-year conditional green card. However, if by the time USCIS issues the green card—that is, when your case is approved—your marriage has already lasted more than two years, they will issue a ten-year permanent green card.
What documents should you prepare to prove your marriage is genuine? There are many kinds of evidence. Typically, we provide photos of your daily life together, chat history, joint bank accounts, or a lease showing that you live together, along with other evidence to demonstrate that the marriage is genuine.
Can a U.S. citizen petition for a stepchild? Yes, but three conditions must be met. First, when the marriage took place, the child must have been under 18 years old. Second, the child must be unmarried. Third, when filing the petition, the child must be under 21 years old. If these requirements are met, you may file an I-130 petition for the stepchild. If the child does not qualify as a stepchild, then after the parent obtains a green card, the parent may petition for the child as a green card holder.
Can you enter the United States on a tourist visa, get married, and apply for a green card? This is something that requires caution because, under immigration law, there is an informal rule known as the 90-day rule. If, upon entry, you stated that you were visiting for tourism, but within less than 90 days you got married and filed a marriage-based green card application, USCIS may sometimes determine that your intent at entry involved misrepresentation. Therefore, in most cases, after entering the United States on a B visa, clients usually wait until after 90 days before getting married and filing a marriage-based green card application.
If someone has a criminal record, can they still petition for a spouse? Generally, yes, with limited exceptions. For example, if the offense involves domestic violence, sexual assault, or crimes against children, then it may not be possible to file a marriage-based petition.

可以用旅游签证来美国结婚申请绿卡吗?这是一个非常需要注意的事情。移民法上有一个不成文的规定,也就是90天的原则。如果你入境的时候,你说你是来旅游的,如果你在90天不到的时间内结婚,并且递交了婚姻绿卡的申请,有些时候移民局会认为你入境的倾向是有欺诈行为的。所以一般情况,用B签证入境美国之后,客户会在90天之后才结婚,以及递交婚姻绿卡的申请。
