Is Premium Processing for My H-1B Worth It or a Waste of Money?

Hello everyone, when applying for an H-1B, clients often ask us a question — that is: “Can you take a look at my case and see if I should request premium processing? What are the benefits of premium processing, and are there any drawbacks?” Let’s talk about it today.

Premium processing means if you pay the additional premium fee, USCIS must respond within 15 business days with a result. It could be an approval, it could be a Request for Evidence (RFE), or it could be a denial. That’s the definition of premium processing.

So should your case be expedited? It depends on the specific circumstances. For example, we recently had a case where the applicant was in their H-1B grace period and wanted to transfer to a new employer. But his previous H-1B had some tricky issues. So I preferred that he get a decision during the grace period to see the outcome of the case — whether USCIS would approve it. If not approved, I would still have an option to change his status to another visa type.

So in such cases, if we really need a quick decision to inform how we plan the next steps, we do recommend premium processing.

There are also cases where the employer is a startup company that wants to file an H-1B for an employee. But their funding isn’t secured, and the employee isn’t fully onboard. In that situation, I would not recommend premium processing. We would prefer regular processing to give the company enough time to prepare supporting evidence and strengthen their case.

首先，加急申请是指如果你递交了加急费，移民局需要在15个工作日之内给你出结果。有可能是直接批准，有可能是补件，也有可能是被拒绝。这就是加急申请的定义。

那么你的案子适不适合加急，这个要分案子情况来决定。比如说最近有一个案子，他是在H-1B的宽限期之内，他希望转到另外一个雇主，但是他之前的H-1B其实有些tricky的地方。所以我是希望他在宽限期之内，这个案子就出结果，看看移民局到底批不批准。如果不批准的话，我还有一个选择，就是把它从H-1B转到别的签证。

所以这种如果我们非常需要它马上出结果，从而影响我们对于案子未来判断，我们是建议客户加急申请的。

还有一种案子，比如说他是一个初创企业，他想给他的员工办H-1B。但是他是资金也没有到位，员工也没到位。那在这个情况下，我就不建议他加急。我们就希望通过非加急，给这个公司足够的时间准备证据，去完善他公司的资料。
