Filed I-485 and Planning to Travel? Wait—You Might Lose Your Green Card!

Recently one of our clients filed an I-485 application and then told me, “Lawyer, my application has been submitted. I want to travel back to China next month, is that okay?”
I smiled and said, “That’s a big problem.” If you leave the US now, it would be equivalent to you voluntarily abandoning your adjustment of status application.
However, don’t panic — there are two exceptions.
The first one is if before departure you received an Advance Parole document, also known as Advance Parole.
The second exception is that even if you haven’t received Advance Parole or you didn’t apply for one, but you are currently in H-1B status or L-1 visa status, and you reenter the US using your H-1B or L-1 visa, this is also an exception.
However, please be aware that if you are H-1B or L-1, and your visa renewal gets denied abroad, and you don’t have Advance Parole, then your plane ticket really becomes a one-way ticket — you won’t be able to come back.
Of course, later on you might come back on another visa, but your I-485 application will have issues.
So I usually remind clients that regardless of what type of visa you’re applying under, we should always file for Advance Parole. Whether we end up using it or not is something we can decide later.
Having Advance Parole in hand acts like a protective shield. This way, even if you need to travel urgently, you can still manage to fly out with peace of mind and return smoothly.

最近我们一个客户递交了I-485的申请，然后跟我说，律师，我的申请递交了，我下个月想回国一趟，没有问题吧。
我当时就笑着说，问题大了。如果你现在离境，那么相当于说你自动放弃了境内转身份的申请。
当然不要慌，有两个例外。
第一个，就是你在离境之前收到了回美证，也就是Advance Parole。
第二个例外，就是你虽然没有收到Advance Parole，或者你没有申请，但是你目前是H-1B或者是l签证的身份，你通过H-1B或者L-1签证的身份入境美国，这也是一个例外。
当然需要注意的是，如果你是H-1B或L-1，你回国的时候签证被拒了，你又没有回美证，那么你这一趟机票就真的成单程机票了，就回不来了。
当然你之后可能会通过别的签证回来，但是你这个I-485申请就会有问题了。
所以我一般提醒客户，不管你是什么签证的申请，我们都要递交一个回美证，我们用还是不用，这是我们到时候再考虑的事情。
那么拿着回美证，你就有一个护身符了。这样，哪怕你是有急事要回国，你也可以做到安心飞-顺利回。
