Nearly Two Years Married but Still a 2-Year Green Card? Here's Why!

In handling our marriage-based green card cases, the most difficult issue is not documents, not missing evidence, but the issue of timing. Because according to immigration law, if USCIS is approving your case when your marriage is less than two years old, they will issue a 2-year conditional green card. If your marriage is already two years old, then you will receive a 10-year permanent green card. Two years and ten years actually differ by eight years.


Recently we had a marriage-based green card applicant who, being only three days away from reaching the two-year mark, received his green card approval. So he received a two-year conditional green card. Meaning after those two years, he must submit Form I-751 to obtain the 10-year green card.


So you see, just three days between 2 years and 10 years makes an eight-year difference. So we can see USCIS's principle is that whether it’s two years or ten years depends on the moment they approve your case, whether your marriage has reached two years or has not reached two years.


Here is a small reminder. If your marriage is close to two years and you happen to have your marriage-based green card interview, you may consider asking during the interview and discussing with the officer to see whether the officer can delay the approval slightly, wait until your marriage passes two years, and then approve your case so you can directly receive a 10-year permanent green card.


Marriage-based green cards don’t look at your plan — they depend on timing and luck. Sometimes just a few days determine whether you get a 10-year green card or a 2-year one followed by the I-751 petition.

我们这里有一个小提醒。如果你的结婚已经快2年了,而你又有了一个婚姻绿卡的面试,你不妨在面试的时候跟移民官商量商量,看移民官能不能等一下你的批准,等你的结婚满2年的时候再批你的申请,直接给你一个10年的永久绿卡。


婚姻绿卡他不看时间,看运气。有些时候,就差几天,决定了你到底是拿10年绿卡还是获得2年绿卡,随后递交I-751的申请。
