H-1B抽签要改?移民协会如何反对?

最近移民局针对 H1B 抽签发布了一项最新的提案,也就是 H1B 抽签用工资等级来抽签,而不是随机抽签。其实这个法案听起来是吸引了高薪的人才,但是仔细分析下来的话,后患无穷。


美国移民协会 AILA 也是针对这个提案公开提出了反对意见,他们指出了四个关键的问题。


首先,工资它不等于人才的价值。AILA 认为,这个提案建立在一个错误的假设上,就是高工资等于高贡献。其实我们知道,美国的创新体系依赖的是多层次的人才结构,包括刚毕业的硕士博士、医生住院医师、教师和工程师。如果抽签只看薪水,那进入职场的年轻专业人士几乎是没有机会的。


第二个问题是它违反了移民和国际法。因为按照法律,H1B 名额的分配顺序应该是按照递交的顺序来抽签,而不是按照工资等级。


第三,对美国创新和经济的伤害。根据移民局的统计,如果用工资等级抽签,那么一级工资人的中签率将下降 48%。这就意味着,刚从美国大学毕业的毕业生,他们的机会是非常少的。而我们整个社会里面,不仅需要高级的人才,我们也需要初级的人才。长远看来,这会削弱美国的创新能力,让优秀的人才流向加拿大、英国等其它地方。


第四,时间安排也不是很合理。因为我们知道 H1B 是一个需要准备的过程,其实在有些行业,H1B 可能在 8 月份的时候就已经在准备明年的抽签申请了。那么突然推出这个法案,对于公司、对于移民律师来讲,都是一个措手不及的现象。


所以 AILA 也建议,如果移民局真的要按工资等级抽签,那也不应该是 2026 年执行,而是需要给整个社会额外的时间,比如说 2027 年才开始实施。


这次 AILA 的立场非常明确,就是工资不能决定一个人的价值,更不能决定谁能为美国的创新和经济做出贡献。


最后我想说,其实美国的移民体制并不是把谁排挤出去的一个系统,而是留住谁在美国能够让美国更强。政策可以调整,但是公平和法治是不能被忽略的。

Recently, USCIS issued a new proposal regarding the H-1B lottery, introducing a major change. That is, the H-1B lottery would be based on wage levels instead of a random selection. While this proposal seems aimed at attracting high-paid talent, a deeper look shows it may cause serious problems.


The American Immigration Lawyers Association (AILA) has publicly responded to this proposal with clear opposition, identifying four key concerns.


First, wages do not equate to a person’s value. AILA believes this proposal is based on a false assumption—that high salary means high contribution. However, we know America’s innovation system relies on a multi-layered talent structure, including recent master’s and PhD graduates, resident physicians, teachers, and engineers. If selection is based only on salary, young professionals entering the job market will have almost no chance.


Second, it violates immigration and international law. Under the law, H-1B allocation should follow the order of filing for the lottery, not be based on wage levels.


Third, it harms U.S. innovation and the economy. According to USCIS data, if the lottery is wage-based, applicants at wage level 1 will see a 48 percent drop in the selection rate. This means recent U.S. graduates will have very limited chances. Across society, we not only need top-level professionals, but also entry-level talent. In the long run, this will weaken America’s ability to innovate and drive talent toward Canada, the UK, and other countries.


Fourth, the timing of this rule is also unreasonable. As we know, the H-1B process requires months of preparation. In some industries, planning for the next year’s H-1B lottery begins as early as August. If this rule is suddenly introduced, it creates a very disruptive situation for companies and immigration attorneys.


Therefore, AILA recommends that if USCIS truly intends to adopt wage-based selection, it should not begin in 2026. Instead, the public should be given more time to prepare, for example, starting implementation in 2027.


AILA’s position is very clear: wages should not determine a person’s worth, and certainly should not determine who gets to contribute to America’s innovation and economy.


Finally, America’s immigration system is not designed to push people out, but to retain those who make the country stronger. Policies can be adjusted, but fairness and the rule of law must never be ignored.
