最近我们看到,越来越多的中国学生在境内递交 F1 转身份的时候呢,收到了拒绝意向书 NOID。不是补件哦,是 NOID。那么理由是什么呢?10043 总统令。
那么这个 10043 总统令是 2020 年川普总统颁布的。它针对的是跟中国的某些高校、某些专业比较敏感的这些 F1 的人员的禁止入境法规。那么它本来是针对禁止入境的,但是我们现在看到,它这条法规越来越多地运用到了境内的 F1 转身份的申请里面。
那么移民局他真正担心的是什么呢?其实很简单。他们怀疑这个申请人,他不回国面签 F1,是因为他知道一旦回去,在使馆就可能被拒。所以这个申请人,才选择留在美国境内转身份,想要规避签证审查。
根据我们的总结,AI、数据分析、或者工程类的这些专业的学生呢,尤其会收到拒绝意向书,是一个比较敏感的专业类型。
不过不要慌,这个只是拒绝意向书。移民局其实给了大家 30 天的时间来递交资料。
那么递交哪些资料会比较好呢?我们首先会建议递交一些资料来证明你是一个品行良好的人,比如说你在社区参加的活动,社区负责人给你写的推荐信,或者你的导师给你写的信,或者是说你的同事、你的朋友给你写的信。
同时作为律师,我们会分析你已经读的专业和你未来马上要读的专业是不是敏感专业,我们来进行论述。只有把你获得的证据和律师的论述加起来,才能让移民局相信你,虽然马上即将要读这些专业,或者你已经读过这些专业,但是你的 F1 申请是出于学术的目的,而不是为了规避签证的审查。
所以我们要提醒大家,在美国境内转身份,一定要了解 10043 总统令,避免踩到红线。

Recently we have seen more and more Chinese students filing F-1 change of status applications within the US during their change of status process, receiving Notices of Intent to Deny (NOID). Not Requests for Evidence, but NOIDs.
So what’s the reason? Presidential Proclamation 10043.
This Proclamation 10043 was issued by President Trump in 2020. It targets certain Chinese universities and sensitive academic fields among students applying for F-1 visas, as a restriction on entry into the US.
This was originally meant for barring entry into the US, but now we’re seeing this regulation being increasingly applied to change of status applications filed within the US.
So what is USCIS really concerned about? It is actually quite simple. They suspect the applicant is avoiding going home for F-1 visa stamping because they believe once they return, they will be denied at the consulate. So the applicant chooses to stay in the US to change status here, trying to bypass the visa screening process.
Based on our analysis, AI, data analytics, or engineering-related majors — students in these fields — are especially likely to receive NOIDs because they’re considered sensitive fields of study.
But don’t panic. It’s only a NOID. USCIS actually gives you 30 days to respond with supporting materials.
So what kind of materials should you submit? We would first recommend providing documents to show you are a person of good moral character, such as records of community involvement, letters of recommendation from community leaders, letters from your professors, or perhaps from your coworkers or your friends.
As your attorneys, we will analyze your past program of study and your upcoming degree program to determine whether they’re considered sensitive, and provide legal analysis. Only by combining your documents with the attorney’s arguments can we convince USCIS that although you are about to study these majors, or have studied them in the past, your F-1 application is for academic purposes and not to bypass the visa process.
So we want to remind everyone, if you are applying to change status within the US, you must understand Proclamation 10043 and avoid triggering red flags.
