H-1B现在还没批,要不要慌?

最近,很多客户联系我们,提出了一个共同的问题:我的H-1B现在还没有批准,是不是我的案件出了问题?


答案是否定的。


今年移民局(USCIS)的整体审批速度明显放缓。原因在于,移民局加大了审批的力度,对每一份资料都进行极为细致的审查,几乎每一页文件都会被仔细查看。


然而,移民局的人手是有限的,而所需审查的材料数量却比以往更多。这种情况直接导致了整个申请流程的节奏减慢。


我们律所目前只有大约20%的客户收到了结果,其余80%的客户仍在等待中。我也与其他移民律师同行进行了沟通,大家的情况基本相同。


因此,如果移民局尚未出结果,并不代表你的案件存在问题,只是整体审批速度放缓。


面对这种情况,很多客户会问:是否应该申请加急处理(Premium Processing)?


如果你希望尽快拿到结果,或者在结果未出的情况下,担心自己的身份会出现断层,我建议你选择加急处理。


但也有一部分客户来自初创公司,他们可能需要更多时间来完善公司的资料,比如资金尚未到位、人员配置不齐全等。对于这类客户,他们反而希望移民局审理得慢一些,这样如果出现补件(RFE),他们就能准备更充分的材料提交。


对于这样的客户,我们通常不建议申请加急处理。

Recently, many clients have contacted us with a common question: My H-1B has not been approved yet—does that mean something is wrong with my case?


The answer is no.


This year, the overall processing speed of USCIS has slowed down significantly. The reason is that USCIS has increased its level of scrutiny in adjudications. Every document submitted is being reviewed extremely carefully—almost every single page.


However, USCIS has limited manpower, while the amount of materials to review has grown considerably. This has resulted in a significant slowdown in the overall application process.


At our law firm, only about 20% of clients have received decisions so far, while the remaining 80% are still waiting. I have also spoken with other immigration attorneys, and they are seeing similar approval timelines.


Therefore, if USCIS has not yet issued a decision, it does not mean there is a problem with your case—it simply reflects the slower processing pace.


Many clients then ask whether they should apply for premium processing.


If you want to receive a decision quickly, or if your immigration status might be at risk of a gap without a timely decision, I recommend applying for premium processing.


However, for clients working with startup companies, additional time may be beneficial. They might need more time to strengthen their company profile—for example, securing adequate funding or completing team staffing. Such clients may actually prefer USCIS to process the case more slowly, so that if a Request for Evidence (RFE) is issued, they can prepare more complete supporting documents.


For these clients, we do not recommend premium processing.
