纽约买房午夜惊魂，客户买的到底是Condo还是Co-op?

前两天，我们律所的一位购买 condo 的客户，在凌晨 1 点的时候连续打电话给我。
他的焦急问题是：
“我买的是 condo 吧？不是 co-op 吧？”
原来在准备购房申请时，对方经纪需要他填写几封推荐信，而推荐信的模板上写的是 co-op。这让客户非常担心，于是半夜急忙打电话确认。
其实真相特别简单：对方经纪给错了，发了一个 co-op 的模板。而且这个楼盘我们团队已经经手过很多次，在尽职调查文件里，我们清清楚楚调出了该楼的 condo declaration，可以确认它就是一个 condo。于是我们立刻回复他：“放心吧，这是 condo，那个只是个模板，不用担心。”
这件事其实说明了一个很重要的问题：买房时，这到底是 condo 还是 co-op，并不是 StreetEasy、Zillow 之类网站写的，也不是对方经纪、卖方律师、甚至卖家本人告诉你的，更不是买方经纪随口说的。最终的确认，应该由买方律师在签订合同前通过尽职调查文件来核实。
买房尽调到位，半夜不心跳。

A couple of days ago, one of our condo-buying clients called me around 1 a.m., clearly panicked.
His urgent question was:
“I bought a condo unit, right? Not a co-op unit, right?”
Here’s what happened: while preparing the purchase application, the seller’s agent asked him to provide several reference letters. However, the template he received stated that the building was a co-op. Naturally, the client became worried and called me in the middle of the night to confirm.
The truth was very simple: the seller’s agent had mistakenly provided a co-op template. Our team has worked on this building many times, and in the due diligence documents, we had already reviewed and confirmed the building’s condo declaration. It is, without question, a condo. So we immediately reassured him: “Don’t worry, this is a condo. That reference letter was just a template.”
This highlights an important point: when buying property, whether it’s a condo or a co-op is not determined by what StreetEasy, Zillow, or any other listing site says. It’s not what the seller’s agent, the seller’s attorney, or even the seller tells you. It’s not even what your buyer’s agent says. The confirmation must come from your buyer’s attorney, who reviews and verifies it in the due diligence documents before you sign the contract.
With proper due diligence, there’s no midnight panic.
