最全F-1新规解答2 ——I-94固定日期期限怎么算？

本节公式适用于生效日（9/15/2026）之后通过以下四种途径取得固定日期期限的情形：(1) 首次入境；(2) 重新入境；(3) 在美境内 EOS 获批；(4) 从其他非移民身份 COS 到 F-1 获批。生效日前以 D/S 入境且符合过渡条件的人，不会在生效日自动改成固定日期；但如果之后需要超过过渡期限继续留美，就要通过上述途径取得固定日期期限。


生效后入境／重新入境：CBP 给 I-94 固定日期


前提： 以下公式适用于9/15/2026（生效日）当天或之后由 CBP 签发的 I-94。生效日前入境的 F-1 仍取得 D/S（见第二节旧规则），不适用本节公式。

8 CFR 214.2(f)(5)(i) General 原文：

“An F-1 student is admitted for a fixed period of time, which is the period necessary to complete the course of study indicated on the Form I-20, or successor form, not to exceed a period of 4 years, plus additional times noted in this paragraph (f)(5)(i)… An F-1 student described in this section may be admitted for a period of up to 30 days before the indicated report date or program start date listed on the Form I-20. An alien described in this paragraph (f)(5)(i) may remain in the United States for an additional 30 days as provided in paragraph (f)(5)(v). The 30-day period before the indicated report date or program start date and 30 additional days following the program end date or the 4-year maximum period of admission do not count toward the maximum length of stay.”


DHS 讨论中对起算点的明确说明：


“The calculation of the 4-year maximum period of admission will not begin from the date of admission during that 30-day arrival window, but from the program start date. Similarly, the 30-day departure periods for F-1 and J-1 nonimmigrants will not count towards the 4-year maximum period of admission.”


计算公式（准确版）：


I-94 admit-until date = 两者取其早 (I-20 项目结束日, 项目开始日 + 4 年) + 30 天

分步理解（普通学术项目）： 1. 先看 I-20 上的项目结束日； 2. 再计算“项目开始日 + 4 年”； 3. 两者取较早者； 4. 最后再加 30 天宽限期（离境或合法维持身份）。

注意： 4 年从项目开始日算，不从入境日算。入境前最多 30 天和结束后 30 天宽限期均不占 4 年上限。


生效后境内 EOS 或 COS 获批：USCIS 给新的 fixed date


8 CFR 214.2(f)(7)(vi) 原文：

“If an application for extension is granted, the F-1 student and the student’s F-2 spouse and children, if applicable, are to be given an extension of stay for the period of time necessary to complete the program as listed on the F-1 student’s Form I-20, or successor form, or requested practical training, not to exceed 4 years. The 30-day period before the indicated report date or program start date and 30 additional days following the program end date or the 4-year maximum period of admission do not count toward the maximum length of an extension.”

含义： EOS 获批后，USCIS 给出的新固定期限使用与入境时相同的计算逻辑——I-20 上剩余项目时间或实践训练所需时间，不超过 4 年，前后各 30 天不计入上限。


典型例子（以下均假设在 2026 年 9 月 15 日（生效日）之后入境或获批 EOS / COS）：


张同学 D（硕士 2 年，2027 春季入学）： - I-20 项目：2027/1/15 – 2028/12/15 - 2026/12/20 入境（前 30 天窗口） - 项目开始 + 4 年 = 2031/1/15；项目结束 = 2028/12/15（较早） - I-94 = 2029/1/14（项目结束 + 30 天） - 若只完成当前课程、不延毕、毕业后不申请 OPT → 通常不需 EOS - 若毕业后申请 post-completion OPT → 除过渡豁免外，仍需 EOS 或离境后 CBP 入境取得新固定期限

张同学 E（本科 4 年，2027 秋季入学）： - I-20 项目：2027/8/25 – 2031/5/15 - 2027/8/1 入境 - 项目开始 + 4 年 = 2031/8/25；项目结束 = 2031/5/15（较早） - I-94 = 2031/6/14 - 若正常 4 年读完、不延毕、不申请 OPT → 通常不需 EOS - 若延毕 或 毕业后想申请 OPT → 需申请 EOS 或重新入境

张同学 F（PhD 6 年，2027 秋季入学）： - I-20 项目：2027/8/25 – 2033/5/15 - 项目开始 + 4 年 = 2031/8/25（较早）；项目结束 = 2033/5/15 - 4 年封顶 → I-94 先给到 2031/9/24（项目开始 + 4 年 + 30 天） - USCIS 最迟须不晚于 I-94 到期日（2031/9/24）收到 EOS，才算及时递交 - 【就业风险提醒】 如果张同学 F 有 助教（TA）、助研（RA）、校内工作或 CPT，如需保留符合条件的就业自动延长，USCIS 应不晚于 2031/8/25（含当日）收到 EOS；若在之后 30 天宽限期内才递交，EOS 仍可能属于及时递交，但就业不能自动继续，须停工等审批 - EOS 是否批准由 USCIS 决定；不是自动重置
