PERM审批拖到天荒地老？公司情况有变！怎么办？

PERM的审批时间现在是越来越长了，都已经长达到15个月了。在这15个月里面，其实我们可能会发生各种各样的情况，那怎么处理呢？

我其实接到了非常多的咨询。第一个就是说，公司换地址了。这个就要看你是换到哪里。比如说从纽约的下城换到了上城，其实这不影响的，因为它还是在同一个MSA（Metropolitan Statistical Area）里面，就没有问题。

但是如果公司整体搬家了，那就会有问题了。我们就会问，之前申请时写的是在纽约工作，现在公司搬到了加州，那如果你绿卡拿到之后，是继续在加州工作，还是说公司会搬回纽约？因为如果你最终是在加州工作的话，这就涉及到对PERM申请的重大变化（material change），这种情况下就需要重新递交PERM申请，不能再用现有的PERM申请了。

我们最近还有两个案例是公司重组了。比如之前是A公司帮你做PERM申请，但A公司现在不存在了，B公司继承了A公司所有的资产和债务。那么在这种情况下，B公司能不能递交I-140申请，还是需要重新申请？我们律师就要看公司是否符合继承（successor-in-interest）的条件，从而做出判断。

总体来说，在PERM pending期间，最好不要有大的变化。如果有重大变化，可能会导致当前的PERM失效，需要重新递交。这种情况下，一定要和律师详细沟通，寻求专业建议。

The PERM processing time is getting longer and longer, and it has now reached up to 15 months. During these 15 months, many things may happen — various unexpected changes. So, how do we deal with them?

I’ve received many inquiries. The first common question is: what if the company changes its address? It depends on where the company moves. For example, moving from downtown Manhattan to uptown Manhattan usually doesn’t affect your case because it’s still within the same Metropolitan Statistical Area (MSA), so it’s not an issue.

But if the company moves out of state entirely, then we have a problem. We would need to ask: if we previously stated your work location as New York and now your company has moved to California, after your green card is approved, will you continue working in California or will the company move back to New York? Because if you end up working in California, that involves a material change to the PERM application. In such a case, we need to refile the PERM application — we cannot use the existing PERM anymore.

Recently, we also had two cases where the companies underwent restructuring. For example, Company A, which filed your PERM, no longer exists, and Company B inherited all assets and liabilities of Company A. In this situation, can Company B file the I-140, or do we have to start over? We attorneys need to determine whether it meets the successor-in-interest criteria to make a legal decision.

Overall, during the PERM pending period, it’s best to avoid major changes. If there are material changes, your existing PERM could become invalid, and you may need to start over. You should consult with an attorney in such cases.
