NYC closing isn’t the end—did you get the keys?

前阵子,我们作为买方律师,帮客户购买了一套公寓,过户过程一切顺利,卖方律师也书面确认交易完成。


但是偏偏在取钥匙的时候出了岔子。因为卖家本人不在纽约,这次采用的是远程过户——也就是说,卖家提前签好文件,由卖方律师寄给我们签署。结果在过户桌上,卖家、卖家律师、卖家经纪都不在现场。


卖家把钥匙留给了大楼的门卫,想着等律师通知门卫后,买家就能直接取钥匙。但这栋楼的管理非常严格。虽然卖家提前和门卫说好了,但当我们的客户去取钥匙时,门卫却坚持不给,说必须得到管理公司的授权才行。


这就很麻烦了。我们立刻出手处理。

第一步,联系卖家律师,请他给管理公司发确认信,说明过户已经正式完成;

第二步,马上联系管理公司,但负责这个过户的工作人员偏偏不在,只好紧急找到另一位负责人。我们告诉他,过户文件的原件昨天已经寄出,并附上追踪号码。为了不耽误客户入住,我们建议先用复印件确认。


经过多封邮件和反复电话沟通后,管理公司终于同意通知门卫放行,我们的客户顺利拿到钥匙。


这就是纽约买房的真实情况。过户不是终点,有时候,它才是新的考验。律师的作用,就是在关键时刻出手,帮客户协调到底,把问题解决。

A few weeks ago, we, as the buyer’s attorneys, helped our client purchase a condo unit in New York. The closing process went smoothly, and the seller’s attorney confirmed that everything was completed.


But just when it came time to pick up the keys, something went wrong. Because the seller was not physically in New York, the closing was done remotely — the seller had signed all documents in advance, and the seller’s attorney mailed them to us for the buyer’s signature. As a result, at the closing table, the seller, the seller’s attorney, and the seller’s agent were all absent.


The seller had left the keys with the building’s doorman, assuming that once the closing was done, the attorney could notify the doorman and the buyer could simply pick them up. However, the building had very strict management rules. Even though the seller had informed the doorman beforehand, when our client went to get the keys, the doorman refused, saying he needed authorization from the management company first.


That made things complicated. We took immediate action.

First, we contacted the seller’s attorney and asked him to send a confirmation letter to the management company, stating that the closing was officially completed.

Second, we reached out to the management company directly — but the person in charge happened to be out of office. We urgently contacted another representative and explained that the original documents had already been mailed, providing the tracking number, and suggested using a copy temporarily so our client could obtain the keys.


After several rounds of emails and phone calls, the management company finally agreed to notify the doorman, and our client successfully received the keys.


This is the real experience of buying property in New York. The closing is not the end — sometimes, it’s the beginning of a new challenge. The role of an attorney is to step in at critical moments, coordinate on behalf of the client, and get the issue resolved.
