Can You Use a Home Address or WeWork for H-1B Employer Location?

Recently, a startup client reached out to me with a question. He said, “Lawyer, my company has just started, and all of my employees are working remotely. Can I use my home address as the company address for the H-1B?”
The answer is yes, but only if the company is genuinely operating. For example, there should be actual office equipment at your home, and your company’s tax filings and invoices should consistently list your home address as the business address. In this situation, using a home address is generally acceptable.
In practice, USCIS does not care whether your office is fancy or located in a high-end building. What USCIS truly cares about is whether the company is real and whether the job being offered is legitimate.
So, can a company use shared office spaces such as Regus or WeWork? The answer is yes, as long as it is not merely a virtual membership. In other words, there must be an actual workstation or physical space available. In most cases, if the company has a dedicated workstation or a usable office space, USCIS will allow it.
In summary, an employer’s address can be a home address or a shared office space, but it must be real, verifiable, and actively operating. If these details are handled correctly, the H-1B case is generally on solid ground. If they are handled incorrectly, a Request for Evidence (RFE) is likely to follow.
